Agreement to Terms

By accessing or using Ziglink (ziglink.app, zigl.ink, viaqr.io), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

Description of Service

Ziglink is a link management platform that provides:

  • URL shortening and smart link routing
  • Dynamic routing rules (geo-location, device type, time-based, custom)
  • Analytics and click tracking
  • QR code generation
  • Password protection and link expiration
  • Custom domains (Pro and Business tiers)

Account Registration

Eligibility

You must be at least 13 years old (or 16 in the EU) to use the Service.

Account Security

  • You are responsible for maintaining the security of your account
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access
  • We are not liable for losses due to unauthorized use of your account

Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep it updated.

Subscription Plans and Billing

Free Tier

  • 10 active links (archive old links to free up slots)
  • 1,000 clicks per month + 100-click grace period
  • All routing features included
  • No credit card required

Paid Tiers (Pro, Business, Enterprise)

  • Billed monthly or annually via Stripe
  • Subscription automatically renews unless cancelled
  • Cancellation takes effect at end of billing period
  • No refunds for partial months (except at our discretion)
  • Price increases will be communicated 30 days in advance

Quota and Limits

  • Link limits: Free tier limited to 10 active links. Paid tiers have unlimited links.
  • Click limits: Monthly click quotas reset on the 1st of each month (calendar month).
  • Grace period: 100-click grace period over your limit. After grace period, links still redirect but click tracking stops.
  • Exceeded limits: Upgrade to restore full functionality immediately.

Payment and Taxes

  • All fees are in USD unless otherwise stated
  • You are responsible for applicable taxes
  • Failed payments may result in service suspension
  • We use Stripe for payment processing (see Stripe's terms)

Acceptable Use Policy

You May Use the Service For

  • Legitimate business and personal purposes
  • Marketing campaigns and content distribution
  • App downloads and product launches
  • Event management and QR code campaigns

You May NOT Use the Service For

  • Illegal activities or content that violates laws
  • Phishing, malware distribution, or fraud
  • Spam, unsolicited messages, or deceptive practices
  • Adult content, gambling, or age-restricted content without appropriate warnings
  • Hate speech, harassment, or threats
  • Copyright infringement or intellectual property violations
  • Impersonation or misleading information
  • URL shortening for third-party services (unless you're a paying customer)
  • Automated abuse or attempts to circumvent quotas

Enforcement

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy, with or without notice. We may also report illegal activity to law enforcement.

Content and Intellectual Property

Your Content

  • You retain all rights to the links, destinations, and data you create
  • You grant us permission to use your data to provide the Service
  • You are responsible for ensuring you have rights to all content you link to
  • You represent that your use does not violate third-party rights

Our Intellectual Property

  • Ziglink owns all rights to the Service, including software, design, branding, and content
  • You may not copy, modify, or reverse engineer the Service
  • Our trademarks and logos may not be used without permission

Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.

Data Ownership

  • You own your account data and analytics
  • You can export or delete your data at any time
  • We do not sell your data to third parties

Service Availability

Uptime Target

We target 99.99% uptime but cannot guarantee uninterrupted service. Maintenance, updates, or unforeseen issues may cause temporary downtime.

No Warranty

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

Beta Features

Features marked as "beta" or "coming soon" are experimental and may change or be discontinued without notice.

Limitation of Liability

To the maximum extent permitted by law, Ziglink and its affiliates shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or data loss
  • Third-party actions (e.g., destination URLs, payment processors)

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if you're on the Free tier).

Indemnification

You agree to indemnify and hold harmless Ziglink from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of third-party rights
  • Content or destinations you link to

Termination

By You

  • You may cancel your subscription anytime through the Customer Portal
  • You may delete your account through account settings
  • Deletion is permanent and cannot be undone

By Us

We may suspend or terminate your account if:

  • You violate these Terms or our Acceptable Use Policy
  • Your account is involved in fraudulent or illegal activity
  • Payment fails and you don't update your payment method
  • We discontinue the Service (with 30 days' notice)

Effect of Termination

  • All your links will stop working immediately
  • You will lose access to your account and data
  • We will delete your data within 30 days (except legal obligations)
  • No refunds for unused time (except at our discretion)

Third-Party Services

The Service integrates with third-party services:

  • GitHub: OAuth authentication
  • Stripe: Payment processing
  • Cloudflare: Infrastructure and edge computing

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their actions.

Dispute Resolution

Informal Resolution

Before filing a claim, please contact support@ziglink.app to attempt to resolve the issue informally.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is [Your City], Germany, if permissible by law.

Consumer Rights (EU/Germany)

If you are a consumer (not using the Service for commercial purposes), you have certain rights under EU and German consumer protection law. Nothing in these Terms affects your statutory rights as a consumer.

Right of Withdrawal (Widerrufsrecht)

EU consumers have a 14-day right of withdrawal from distance contracts. However, this right expires if you have requested that the digital service begin immediately during the withdrawal period and you have expressly acknowledged that you lose your right of withdrawal. By subscribing, you agree to immediate access and waive your withdrawal right.

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ziglink.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.

No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not transfer these Terms to anyone else. We may assign these Terms to a successor or affiliate.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (e.g., natural disasters, war, pandemics, infrastructure failures).

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or prominent notice in the Service at least 30 days before taking effect.

Continued use after changes constitutes acceptance of the updated Terms.
